Abraham Evans 1800

This Indenture made the twenty ninth day of September in the fortieth year of the reign of our Sovereign Lord George the third by the grace of God of Great Britain France and Ireland King defender of the faith and so forth and in the year of our Lord one thousand eight hundred between The Right Honorable Henry Earl of Abergavenny of the one part and Abraham Evans of Bishopsgate Street, London woollen draper of the other part witnesseth that as well for and in consideration of the sum of thirty four pounds and sixteen shillings of lawful money of Great Britain by the said Abraham Evans to the said Henry Earl of Abergavenny in hand or before the sealing and delivering of these presents well and truly paid the payment and receipt whereof the said Henry Earl of Abergavenny doth hereby admit and acknowledge as also for and in consideration of the yearly rent hereby reserved and of the covenants and agreements herein contained on the part and behalf of the said Abraham Evans his heirs executors administrators and assigns to be paid done and performed he the said Henry Earl of Abergavenny hath demised and granted and by these presents doth demise and grant unto the said Abraham Evans and his heirs during such lives as are herein after mentioned all that cottage or tenement with the garden and barn thereto adjoining and also all those eight several closes pieces or parcels of arable meadow and pasture land thereto belonging containing altogether by estimation about 10 covers more or less having lands of the said Earl leased to Thomas Prosser and William Griffiths respectively on the north side thereof lands of the said Earl leased to David Valentine on the east side thereof lands of the said Earl leased to Edward James collier and adjoining to the freehold lands of the late John Cooke Esquire deceased on the south side thereof and the high road there leading from Pellenigg to Rhyd y Mirch on the west side thereof all which said heredits and premises are situate lying and being in the parish of Goytrey in the County of Monmouth and now and for several years past in the occupation of William Valentine as tenant thereof to the said Abraham Evans except and there being always reserved out of this demise unto the said Henry Earl of Abergavenny and such person and persons as for the time being shall be intitled to the inheritance freehold or other estate of or in the said hereby demised hereditaments subject to and immediately expectant upon the determination of the lease hereby granted all mines quarries whatsoever and all manner of timber trees and trees likely to become timber and also all coppice woods now standing growing or being or which shall or may at any time hereafter during the continuance of this demise stand grow or be in upon within or under the said demised premises or any part thereof with full and free liberty of ingress egress and regress way and passage to and for the said Henry Earl of Abergavenny and such other person and persons as aforesaid and his and their agents servants and workmen with beasts carts and carriages or otherwise at all times in the year to dig root fell cut down lop crop cord char take and carry away the same to have and to hold the said cottage or tenement garden barn pieces or parcels of land and all and singular other the premises herein before demised or mentioned or intended so to be with the appurtenances except as hereinbefore is excepted unto the said Abraham Evans and his heirs for and during the natural lives of Sarah Evans spinster the daughter of the said Abraham Evans now aged about twenty three years, William Kemp Evans the son of the said Abraham Evans now aged about five years and Elizabeth Aldridge spinster niece of the said Abraham Evans now aged about twenty one years and the life of the longest liver of them yielding and paying therefore yearly and every year during the continuance of this present lease unto the said Henry Earl of Abergavenny and such person and persons as for the time being shall be entitled to the inheritance freehold or other estate in reversion of and in the said premises so hereby demised as aforesaid subject to and immediately expectant upon the lease hereby granted the yearly rent or sum of five shillings of lawful money of Great Britain free from land tax and all other taxes and deductions whatsoever now imposed or hereafter to be imposed by authority of Parliament or otherwise howsoever at the four most usual feasts or days of payment of rent in the year that is to say the twenty fifth day of December the twenty fifth day of March the twenty fourth day of June and the twenty ninth day of September in every year by even and equal portions the first payment thereof to begin and to be made on the twenty fifth day of December next ensuing the date here and also yielding and paying unto the said Henry Earl of Abergavenny or such person or persons as for the time being shall be so entitled as aforesaid the sum of five shillings for and in the name of an heriot on the death of each of the three persons for whose lives respectively the said premises are hereby demised as aforesaid and also the like sum of five shillings on the alienation of the said premises provided nevertheless that if the said Abraham Evans his heirs or assigns do or shall grant demise lease sell assign or part with or from the said hereby demised premises or any part or parcel thereof without the licence or consent in writing under the hand and seal of the said Henry Earl of Abergavenny or such person or persons as for the time being shall be so entitled as aforesaid or his or their steward for the time being of the Manor of Pellenigg in that behalf first had and obtained or shall do or cause or suffer to be done on or near the said hereby demised premises any act project or contrivance whatsoever whereby the same premises or any other of the estates of the said Henry Earl of Abergavenny or of such person or persons as aforesaid or of his or their tenants may be any wise prejudiced damaged or lessen’d in the yearly value thereof respectively or if the said yearly rent or sum of five shillings hereby reserved or any part thereof shall be behind or unpaid by the space of fifteen days next after either of the said feast days on which the same ought to be paid as aforesaid or if the said sum of five shillings hereinbefore reserved and made payable as aforesaid shall be behind or unpaid by the space of six months next after any of the times on which the same ought respectively to be paid or if there shall be any breach of the covenants provisoes or agreements herein contained on the lessees part and behalf at any time or times then and in every of such cases it shall and may be lawful to and for the said Henry Earl of Abergavenny or such person or persons as shall be entitled in reversion as aforesaid into and upon the said hereby demised premises or any part thereof in the name of the whole to reenter and the same to have again repossess and enjoy in his or their former estate any thing hereinbefore contained to the contrary thereof in any wise notwithstanding and the said Abraham Evans for himself his heirs exors and admors doth covenant promise and agree to and with the said Henry Earl of Abergavenny and such person and persons as for the time being shall be so entitled in reversion as aforesaid by these presents in manner following, that is to say, that he the said Abraham Evans his heirs exors admors or assigns shall and will well and truly pay or cause to be paid unto the said Henry Earl of Abergavenny or such person or persons as for the time being shall be so entitled as aforesaid the said yearly rent hereinbefore reserved on the days and times and without deduction and in manner hereinbefore reserved and appointed for payment thereof same and according to the true intent and meaning of these presents and also that he the said Abraham Evans his heirs and assigns shall and will from time to time and at all times during the continuance of this present lease at his and their proper expence well and sufficiently repair uphold amend and keep repair the said cottage or tenement and barn and all and every the buildings gates stiles hedges ditches mounds and fences of and belonging to the said demised premises and the same premises so well and sufficiently repaired amended and kept in repair as aforesaid shall and will peaceably and quietly leave and yield up unto the said Henry Earl of Abergavenny or such person or persons as for the time being shall be so entitled as aforesaid at the expiration or other sooner determination of this present lease and further that he the said Abraham Evans his heirs or assigns shall not nor will during the continuance of this present lease grant demise lease assign or part with or from the said hereby demised premises or any part or parcel thereof to any person or persons whomsoever without the licence or consent in writing under the hand and seal of the said Henry Earl of Abergavenny or such person or persons as aforesaid or of his or their steward for the time being of the said Manor of Pellenigg in that behalf first had and obtained and the said Henry Earl of Abergavenny for himself his heirs executors and administrators as also for such person or persons as for the time being shall be so entitled as aforesaid doth covenant and agree to and with the said Abraham Evans his heirs and assigns by these presents that it shall and may be lawful to and for the said Abraham Evans his heirs and assigns upon payment of the rent and performance of the covenants provisoes and agreements hereinbefore reserved and contained on his and their parts and behalfs peaceably and quietly to have hold and enjoy all and singular the said hereby demised premises without any let denial hindrance or interruption of from or by the said Henry Earl of Abergavenny or such person or persons as for the time being shall be so entitled as aforesaid or any other person or persons whomsoever lawfully claiming or who shall or may lawfully claim from by or under him them or any of them and the said Henry Earl of Abergavenny doth hereby authorize and in his place put and depute Lewis Osborne of the town of Abergavenny in the said County of Monmouth Gentleman and William Morgan of the parish of Lanvair Kilgiden in the same County Gentleman his lawful attornies or attorney jointly or severally for him and in his name to enter into and upon the said hereby demised premises or into any part thereof in the name of the whole and to give livery and seizin thereof unto the said Abraham Evans or to his attorney in that behalf lawfully authorised in order that this present lease may have its due effect.

This indenture made the fowerteenth day of September in the yeare of our Lord according to the computation of the Church of England one thousand six hundred ninety and two betweene the right hono’ble George Lord Abergavenny of the one part and Roger Richard of the parish of Goytre in the County of Monmouth yoeman of the other part. Witnesseth that the said George Lord Abergavenny for and in consideration of the sume of three pound ten shillings of lawfull English money unto him payd before the sealing of these p’sents and for divers other causes and consideration to him there unto …. hath demised graunted and to farme let and by these presents doth demise graunt and to farme let and set? unto the said Roger Richards all that cottage wherein one Alse Robert (mother of the said Roger) doth now inhabit together wth fower akres of land to the said cottage adjoyning all which premises are scituate lying and being in or upon a comon or wast of the said Lords called Pettenny wthin the said parish of Goytre bounded on the south west by a way leading from Abergavenny towards Usk and on the other parts by the lands of Hugh Harries gent and the said west to have and to hold all and singular the fore demised p’misses with thappurtenances unto the said Roger Richard his heyres and assigns for and dureinge the naturall lives of the said Roger Richards, …. his now wife & Blanch Prichard daughter of Wm Pric’d of Goytre and the longest liver of them three yeldinge and payinge therefore yearly unto the said George Lord Abergavenny his heyres and assignes the sume of two shillings of lawfull English money at two tymes or termes in the yeare (vizt) at every the feast of St Michael Tharkangel and thannunciation of our blessed Lady St Mary the Virgin by equall porcons and three shillings in the name of a herriot at the decease or chang of every tenant of the premises dureing the said terme and if it shall happen the said yearly rent of two shillings or three shillings in the name of a herriot to bee behind and unpayd for the space of fifteene dayes next any of the tymes whereon they ought to bee paid being lawfully demanded that ….. from thence forth this present demise to cease and determine any thing herein conteyned to the contrary notwithstanding and the said Roger Richard for himselfe his exors adm’rs & assignes doth heereby covenant to and with the said George Lord of Abergavenny his heyres and assignes that hee the said Roger Richard his exors adm’rs & assignes shall and will at his owne proper cost and charge well and sufficiently repayre the said cottage and alsoe well and sufficiently repayre and amend all the hedges fences & ditches in and around the fower acres of land heereby demised and the same being soe well & sufficiently repayed shall keepe in good and tenentable reparacons and at the end or sooner determination of this demise soe well repayed shall peaceably yeld up unto the said George Lord of Abergavenny his heyres or assignes and the said George Lord Abergavenny doth by these presents authorise and in his place put his well beloved freind Will’m Morgan of Goytre ………. his lawfull atturney for him and in his name to enter into the premises or any part thereof to give livery of seisin in the name of the whole unto the said Roger Richard. This indenture made the thirtieth day of November in the third year of the reigne of our soveraigne Lord James the second by the grace of God of England Scotland France and Ireland King defender of the faith &c Annoq Dni 1687 betweene the Right Hono’ble George Lord Bergavenny of the one part and Roger Jenkins of the parish of Goytrey in the County of Monmouth yeoman of the other part. Witnesseth that the said George Lord Bergavenny for and consideration of the sume of ten pounds of lawfull English money to the said George Lord Bergavenny paid by the said Roger Jenkins in the name of a fine and of the rents and covenants hereinafter reserved hath demised granted and to farme letten and by these p’sents doth demise grant and to farm lett unto the said Roger Jenkins all those two parcells of rough ground called or known by the severall names of Coom Kellyn and Brin Vaur now or late in the tenure or occupation of the said Roger Jenkins lying and being in the said parish of Goytrey except out of this p’sent demise all mines and quarryes of stone oar or any other mettall other than stones to be imployed and used in and upon the p’misses to have and to hold the said p’misses with the appurtenances unto the said Roger Jenkins his heirs and assigns for ands dureing the lives of the said Roger Jenkins, William Jenkins & James Jenkins two of the sonnes of the said Roger Jenkins and lives and life of the survivors & survivor of them yeilding and paying therefore yearly unto the said George Lord Bergavenny his heirs or assigns the sume of eight pence current money at or upon the feasts of the Annunciation of the blessed Virgin Mary and of St Michaell Th’arch Angell by equall porcons and also the sume of five shillings for and in the name of a herriott at the death of every person dying seized of the p’misses by vertue of these p’sents and likewise doeing suit to the Court of the said Lord Bergavenny his heirs and assigns to be held for the Lordship of Bergavenny. And if it shall happen the said yearly rent of eight pence or any part thereof to be behind and unpaid by the space of fifteen days next after any of the said feast days in which the same ought to be paid (being lawfully demanded) then it shall and may be lawfull to and for the said George Lord Bergavenny his heirs and assigns into the p’misses to reenter and the same to have againe repossess and enjoy as in his or their former estate any thing herein contained to the contrary notwithstanding and the said George Lord Bergavenny doth by these p’sents authorize and in his place putt Andrew William of Lanvayr Gilgidin in the said County of Monmouth to be his true and lawfull attorney for him and in his name and place to enter upon the p’misses or any part thereof in the name of the whole and to give possession thereof unto him the said Roger Jenkins according to the tenor of these p’sents. This Indenture made the second day of February in the year of our Lord Christ one thousand seven hundred & fifty five between the Right Honourable George Nevill, Baron of Abergavenny of the one part & Richard Cadogan of the Town of Abergavenny in the County of Monmouth innholder of the other part. Witnesseth that for & in consideration of the sum of one pound & one shilling of lawfull British money on hand paid by the said Richard Cadogan to the said Lord Abergavenny before the ….? of these presents (the receipt whereof the said Lord Abergavenny doth hereby acknowledge for & in the name of a fine) & for & in consideration of the rents covenants & agreements on the lessee’s part & behalf hereinafter mentioned to be paid done & performed he the said Lord Abergavenny hath demised & granted & in & by these presents doth demise & grant unto the said Richard Cadogan all that cott & two acres inclosed (being part of his said Lordships waste in Pellennygg Comon there heretofore in the possn of one Aby Morgan & now of BLANK & scituate lying & being in the parish of Goytrey in the said County by mears & bounds there well known & distinguished all which said cott & premes with appurts were by lease bearing date the twenty ninth of September one thousand seven hundred & one granted to one William Morgan (son of Robert Morgan then of Goytrey labourer) for three lives & which lease lately expired except out of this present demise unto the said Lord Abergavenny his heirs and assigns all mines & quarries of stone oar & coal & all mineralls & other mettalls & all woods timber & trees whatsoever to have and to hold all & singular the said demised premes with appurts (except before excepted) unto the said Richard Cadogan his heirs & assigns from the twenty ninth day of September last for and during the respective lives of William Price (aged twenty one years), Ann Price (aged thirteen years) & Ruth Price (aged ten years) son & daughters of William Price late of Goytrey deceased to the life of the longest liver of them yeilding and paying therefore yearly & every year during the continuance of this present demise & grant unto the said Lord Abergavenny his heirs or assigns the rent or sum of one shilling of lawfull British Money without any deduction for any manner of taxes whatsoever at or upon the feasts of the annunciation of the blessed virgin Mary & Saint Michael the Archangel by even & equal portions the first half yearly rent to be due & payable on the feat of the annunciation of the blessed virgin Mary next coming & the sum of one shilling of like lawfull money for & in the name of an herriott on the death of every person dying seized for on alienation of the premes. And also doing suit to the Court of the said Lord Abergavenny when thereunto required and the said Richard Cadogan for himself his heirs & assigns doth by these presents covenant promise & agree with the said Lord Abergavenny his heirs & assigns that he the said Richard Cadogan his heirs and assigns shall not nor will do or suffer to be done on the premes hereby demised or any part thereof any act project or contrivance whereby any other of the estate of the said Lord Abergavenny his heirs or assigns or his or their tenants may be prejudiced or lessened in yearly value. And if it shall happen that the said yearly rent of one shilling & other acknowledgments herein before mentioned or any part of them shall be behind or unpaid by the space of fifteen days next after any of the said feast days on which the same ought to be paid (being legally demanded) or on breach of any of the covenants or agreements aforesaid on the lessee’s part to be made done suffered or performed that then it shall & may be lawfull for the said Lord Abergavenny his heirs or assigns into the premes hereby demised or any part thereof in the name of the whole to re-enter & the same to have again repossess & enjoy as in his or their former estate any thing herein contained to the contrary notwithstanding. And the said Lord Abergavenny doth hereby & putt Fulford Morgan, Phillip Powell Gentlemen or either of them to his true & lawfull attorneys or attorney jointly or severally for him & in his stead to enter into & upon the premes hereby demised or any part thereof in the name of the whole & to give possession thereof unto the said lessee Richard Cadogan ratifying & by these presents allowing & confirming all & whatsoever the said attorneys or either of them shall lawfully do in the premes as fully & effectually as if the said Lord Abergavenny was personally present at the doing thereof. This indenture made the second day of February in the year of our Lord Christ one thousand seven and forty nine and in the twenty third year of the reign of our Sovereign Lord George the Second King of Great Britain and so forth between the Right Honourable George Lord Abergavenny of the one part and Francis Morgan of the parish of Goytrey in the County of Monmouth yeoman of the other part.

Witnesseth that the said Lord Abergavenny for and in consideration of the sume of five pounds of lawfull British money to him paid by the said Francis Morgan at or before the execution of these presents the receipt whereof he the said Lord Abergavenny doth hereby acknowledge for and in the name of a fine ( and for and in consideration of the rents and covenants herein after reserved) hath demised granted and to farm let and in and by these presents doth demise grant and to farm lett unto the said Francis Morgan all that one lot and four acres of land with the appurtenances being a part of his Lordship’s waste in Pelleny in the said parish of Goytrey (all which said premisses were by indenture of lease bearing date the twenty ninth of September one thousand seven hundred and one granted to William Prichard then of Goytrey victualler to hold for the lives of the said William Prichard and of Richard and Mary his son and daughter at the yearly rent of two shillings and sixpence which said lease expired in May one thousand seven hundred and forty six (except out of this present demise unto the said Lord Abergavenny his heirs and assigns all mines and quarries of stones oar and coal and all woods timber and trees whatsoever now growing and being in and upon the said granted premises or any part thereof with free liberty of ingress egress and regress so at all convenient and seasonable time and times in the year during the term hereby granted to and for the said Lord Abergavenny his heirs and assigns his and their servants agents and workmen at his and their will and pleasure with horses cattle and carriages into through and from the said hereby granted premisses or any part thereof to cut down hew digg work and carry away all the same mines stones oar coal woods timber and trees and to have full liberty of ingress egress and regress to take and carry away the same or any part thereof at all seasonable and convenient time and times in the year doing thereby as little hurt or damage as may be to the corn grain hay or grass of the said Francis Morgan his heirs or assigns growing increasing or being or which shall during the said term hereby demised and granted grow or be in or upon the said lands and premisses from time to time in carrying away all part of the same mines stones oar coal woods timber and from whatsoever respectively to have and to hold all and singular the same premisses with the appurtenances (except what are here in before excepted) unto the said Francis Morgan his heirs and assigns from the twenty ninth day of September last past for and during the respective lives of Mary Morgan aged about eleven years, William Morgan aged about five years and Francis Morgan aged about 2 years the daughter and sons of the said lessee Francis Morgan) and the life of the longest liver of them yeilding and paying therefore yearly and every year during the continuance of this present demise and grant unto the said Lord Abergavenny his heirs or assigns the rent or sume of two shillings and six pence of lawfull British money without any deductions for any manner of taxes whatsoever at the feasts of the Annunciation of the blessed Virgin Mary and Saint Michael the Archangell by even and equal portions the first half yearly rent to be due and payable on the feast of the Annunciation of the blessed Virgin Mary next ensuing and the sume of two shillings and six pence of like lawfull money for and in the name of an heriott on the death of every person so dying seized or on alienation of the premisses and also yeilding and paying two fat hens at Christmas yearly and doing suit to the Court of the said Lord Abergavenny to be held for the Lordship of Bergavenny when thereunto required and shall not nor will erect or build nor cause or suffer to be erected or built any other cott or cottage on the premises hereby demised nor will alien or assign this present demise and grant without leave first had and obtained in writing under the hand and seal of the said Lord Abergavenny his heirs or assigns and shall not nor will do or suffer to be done on the premisses hereby demised any act project or contrivance whereby any other of the estate of the said Lord Abergavenny his heirs or assigns or his or their tenants may be prejudiced or lessened in yearly value and if it shall happen that the said yearly rent or sume of two shillings and six pence and other acknowledged g….. herein before mentioned or any part of them shall be behind and unpaid by the space of fifteen days next after any of the said feast days and on which the same ought to be paid being lawfully demanded or breach of any of the covenants or agreements ………. lessees ….. then it shall and may be lawfull to and for the said Lord Abergavenny his heirs or assigns into the said hereby demised premisses to re-enter and the same to have repossess and enjoy as in his or their former estate anything herein before contained to the contrary in any wise notwithstanding and the said Lord Abergavenny doth hereby authorize and in his place put Phillip Lewis of Abergavenny yeoman and Thomas Jenkins of the same place yeoman or either of them to be his true and lawfull attorneys or attorney jointly or severally for him and in his stead to enter into and upon the premisses hereby granted or any part thereof in the name of the whole) and to give possession thereof unto the said lessee Francis Morgan ratifying allowing and confirming all and whatsoever the said attorneys or either of them shall lawfully do in the premisses as if the said Lord
