In the name of God the eleventh day of October Ano dni 1671, I John ap John of the pish of Goytresse wthin the diocese of Landaffe being sicke in body but of good and pfect memory (praysed be thalmighty God therefore) doe make and ordaine this my last Will and Testamt in maner and forme followeing. Impris I comend my soule to God my maker & redeemer and my body to be buried in Xptian buriall in the pish church of Lanellen. Item I give devise and bequeath unto Elizabeth my wife all my messuadges lands and tenements wch I purchased of William Phillip of Cwmjoy and also other lands and tenem’ts wch I purchased from Jenkin Parry and Barbara Parry of Trevethin, both wch sd lands and p’mises are scituate and lyeing in thaforesaid sev’all parishes of Goytresse & Trevethin for and dureing the term of her naturall life if she shall soe long continue sole and unmarried. Item after the decease of Elizabeth my sd wife or if it shall happen my sd wife to marry after my decease I give and bequeath thafore menconed messuadge and lands wch I purchased to me & my heirs of thaforesd William Phillip of Cwmjoy unto James John my eldest son his heirs & assigns for ev’ upon the con’ition and consideracon that the said James shall satisfie and pay the sume of tenn pound of current English money unto William John my youngest son or to his executors administrators or assigns when the sd William shall attaine to the age of one and twenty yeares and alsoe after the decease of Elizabeth my said wife or if it shall happen the said Elizabeth to marry after my decease I give likewise and bequeath thaforesaid lands and tenem’ts wch I purchased of Jenkin Parry and Barbara Parry unto William John my son his heirs and assigns for ev’. Item I give devise and bequeath unto Elizabeth my said wife all the lands and tenem’ts which I purchased of Thomas Jones of Lanvrechva for and dureing the full end & tearme of one and twenty yeares next ensuing after my decease if she shall soe long continue unmarried, and after the expiration of the sd tearme of one and twenty yeares or if it happeneth her to marry in the meane time I give and devise the same unto James John my son his heirs & assigns for ev’ upon the condicon of the paym’t of the above menconed sume of tenn pound unto my aforesd son William at and upon the tyme before limited and expressed, and alsoe if my sd son James will then refuse & deny to pay the same unto my son William or his assigns my Will and meaning is that my son William shall possesse and enjoy the said lands menconed to be purchased of Thomas Jones for the space of four yeares next ensueing after such denyall & refusall made and after the expiracon thereof the same to be & remaine unto my said? son James John his heirs & assigns for ev’. Item I give & bequeath unto Elizabeth my said wife soe much wood now growing upon my lands scituate in the pish of Goytresse as will amount to the worth of £40 (if so much may conveniently be spared) and my will is yt the same moneyes be disposed towards a full paym’t and satisfacon made unto Mathew Charles of Lanvethiraine for certain lands I agreed wth him for if the sd Mathew will assure and co’vey the same unto Elizabeth my wife dureing her widdowhood and afterwards to James John my son his heirs & assignes for ev’. Item I give & devise all my psonall estate whatsoev’ unto Elizabeth my wife whom I nominat & appoint to be sole executrix of this my last will & Testam’t and Henry Morgan & William Morgan to be supviso’s thereof. I Catherine Frances Grieve of Goytre in the county of Monmouth, spinster, hereby revoke all former wills and testamentary dispositions made by me and declare this to be my last will and testament.

I appoint Manley Ashwin of Abergavenny in the said county of Monmouth esquire and William Herbert Grieve of the Marylebone branch of the National Provincial Bank of England London, gentleman, hereinafter called my trustees to be executors and trustees of this my will.

I give and bequeath to my nephew Albany Richard Grieve the plate left to me by Miss Yarworth.

I give, devise and bequeath all the rest of my property real or personal of what nature or kind soever and wheresoever situate and all property over which I may have any power of appointment or other disposing power unto and to the use of my said trustees. Upon trust to sell and convert into money such part thereof as shall not consist of money and out of the proceeds of such sale and conversion to pay my debts and funeral and testamentary expenses and to pay my friend the said Manley Ashwin the sum of nineteen pounds [nineteen pounds] and nineteen shillings.

And upon trust to invest the residue at their discretion and to pay the income thereof to my sister in law Elizabeth Grieve for the term of her natural life and after her decease upon trust to pay to my niece, Clara Jessie Grieve [provided she shall up to that time have remained unmarried] the sum of two hundred pounds free of legacy duty and to pay to my nephew the said William Herbert Grieve the sum of one hundred pounds free of legacy duty, and to divided the residue of my said property equally between my three nieces and three nephews namely:

Elizabeth Mary Ritchie, Ellen Frances Ritchie, the said Clara Jessie Grieve, the said Albany Richard Grieve the said William Herbert Grieve and John Coleman Grieve, provided always that if either of my said nieces or nephews shall die in my lifetime leaving a child or children or remoter issue who shall survive me then such child, children or issue shall take per shares and not per capita [and if more than one equally between them] the share which is his, her or their parent or ancestor would have taken if such parent or ancestor had survived me.

And I declare that my trustees may postpone the sale and conversion of all or any part of the property hereinbefore devised and bequeathed to them for so long as they shall think fit and that the income to accrue from such part of the said property as shall for the time being remain unsold and unconverted shall be paid and applied to such person or persons and in the manner to whom and in which the income of the said monies produced by such sale and conversion would be payable if such sale and conversion had actually been made.

The condition of this obligation is such that if ye above bounden Jenkin Rosser & James Rosser the nephews and administrators of all and singular ye goods chells and credits of Catherine Williams late of ye pish of Goytre in ye County of   Monmouth deceased doe make or cause to be made a true and perfect inventory of all and singular the goods chattells and credits of the said deceased which have or shall come to the hands possession or knowledge of   them     the said    Jenkin Rosser & James Rosser  or into the hands and possession of any person or persons for him and the same soe made doe exhibit or cause to be exhibited into the Registry of the Consistory Court of   Landaff  at or before the 7th day of   November next ensuing.

And the same goods chattells and credits and all other the goods chattells & credits of the said deceased at the time of her death which at any time after shall come to the hands or possession of the said    Jenkin Rosser & James Rosser or into the hands & possession of any other person or persons for him doe well and truely administer according to law or further doe make or cause to be made a true and just accompt of their sd ad’con at or before the 7th day of   May 1729   and all the rest and residue of the said goods chattells and credits wch shall be found remaining upon the said administrators accompt the same being first examined and allowed by the Judge or Judges for the time being of the said Court shall deliver unto such person or persons respectively as the said Judge or Judges by his or their decree or sentence pursuant to the true intent and meaning of a late Act of Parliament made in the two and twentieth and three and twentieth years of ye reigne of our late Soveraigne Lord King Charles the second intitled an Act for ye better settling of intestates estates, shall limitt and appoint. and if it shall hereafter appeare that any last will and Testament was made by the said deceased and the executor or executors therein named doe exhibit the same into the said Court making request to have it allowed and approved accordingly if the said  above bounden being thereunto required doe render and deliver the sd Letters of Administration (approbation of such testament being first had and made) in the said Court then this obligation to be void and of none effect or else to remaine in full force and vertue.

Know all me by these presents that we Charity Parry  of the parish of Clythur   in the County of   Monmouth widow and John Holmes of the same parish taylor     are held and firmly bound unto the Right Reverend Father in God Matthias   by divine permission Lord Bishop of   Landaffe     in the sum of   forty       pounds of good and lawful money of Great Britain to be paid unto the said Lord Bishop or to his certain attorney his executors administrators or assigns to which payment well and truly to be made. We oblige ourselves and each of us by himself for the whole our and each of our heirs executors and administrators firmly by these presents. Sealed with our seals dated   the 8th day of May   in the year of our Lord Christ 1739

 

The Condition of this obligation is such that if the above bounden Charity Parry the natural and lawfull sister and next of kinn of Barbara James   late of the parish of the parish of Goytre   in the County of   Monmouth and Diocese of Landaff widow deceased and administratrix of all and singular the goods chattels and credits of the said deceased do make or cause to be made a true and perfect inventory of all and singular the goods chattels and credits of the said deceased which have or shall come to the hands possession or knowledge of her     the said   Charity Parry     or into the hands and possession of any other person or persons for   her and the same so made do exhibit or cause to be exhibited in the Registry of the Consistory Court of Landaffe     on or before the eighth day of November 1740  next ensuing and the same goods chattels and credits and all other the goods chattels and credits of the said deceased do well and faithfully administer according to law, that is to say, do pay the debts of the said deceased which she   did owe at   her   death and then the legacies contained and specified in the said Will annexed to the said Letters of Administration so to be committed as far as   her goods chattels and credits will thereto extend and the law charge     and further do make or cause to be made a true and just accompt of her     said administration when   she   shall be thereunto lawfully required. And all the rest and reside of the said goods chattels and credits which shall be found remaining upon the said administrat accompt and not otherwise disposed of in the said Will the same being first examined and allowed of by the Judge or Judges of the said Court for the time being shall distribute and pay in such manner and form as shall be limited by the direction of the said Judge. I Andrew Parry of ye pish of Goytre in ye county of Monmouth and diocese of Landaff, being weak in body, but (thanks be to God) of perfect mind and memory and calling to mind of uncertain state of this transitory life, and yt all flesh must submit unto death whensoever it shall please God to call, I first then cimend my soul into ye hands of Almighty God hoping through ye merits of Jesus Christ to be absolutely pardon’d for all my sins, and to inherit ye kingdom of heaven, and my body I commit to ye earth to be buried in ye parish church of Goytre, and do order yt my executor hereafter named shall lay out five pounds for my funeral expenses.

And as such touching such goods and chattels which God hath been pleased to bestow upon me, I do order, give and dispose of ye same in manner and form following.

Imp. I give and bequeath to my niece Rachel Walters one brass kettle, already in her possession.

Item. I give and bequeath to my nephew Thomas Walters twenty pounds of currant English money to be paid within six months after my decease.

Item. I give and bequeath to my daughter Margaret William six pounds of ye like currant money to be also paid within six months after my decease, if she or if ye issue yt now she is big with shall then live.

Item. I give and bequeath to my niece Catherine Walters ye bed which I uses to lie on with all it’s appurtenances.

Item. I give bequeath and demise unto my nephew James Jones ye lease land in ye parish of Goytre, together with twenty shillings to be paid him likewise within six months after my decease.

The rest of my household stuff not mentioned I do order yt they be peaceably and equally divided between my two nephews William and Thomas Walters.

I do hereby nominate, make and appoint my nephew William Walters to be ye sole executor of this my last will and testament, revoking, disannulling and making void all other Wills and bequest by me made & declare this to be my last.

The Condition of this obligation is such that whereas the original last Will and Testament of Thomas Jenkins late of the parish of Goytrey in the County of Monmouth and Diocess of Landaffe Esquire deceased (bearing date the twentieth day of December in the third year of the Reigne of our said Sovereigne Lord George the Second by the grace of God of Great Brittain France and Ireland King defender of the faith &c and in the year of our Lord God one thousand seven hundred twenty and nine) is decreed to be delivered out of the Registry of the Consistory Court of Landaffe aforesaid unto the above bounden Robert Hughes one of the trustees therein named. If therefore the said Robert Hughes his heires executors or administrators or either of them shall and will redeliver the said originall Will … and uncancelled in manner as he received the same into the Registry aforesaid when and at such time as he shall be thereunto duely required then this obligation be void or else to remain in full force and vertue.

Imps: I give & bequeath unto my daughter Martha Lewis, ye wife of Timothy Lewis ye sum of ffive pounds to be paid as soon as they can be paid by Mrs Jones of Horimuis? Within ye space of one month next after my decease and also one 3 yearling heffer, one chaff, 4 pewter platters & pewter dish, one pewter candle stick, one brass skillett, 2 blankets & 2 sheets, one bushell of wheat and one cheese.

Imps: I give and bequeath unto my daughter Mary Morgan ye sum of ffive pounds to be paid as afores’d. One cow and chest cupboard, 4 pewter platters a pewter dish, one brass candle stick, one iron marment and one baking tin, one feather bed wherein I now lye with it’s appurtenances and one chest and one black chair & one stone jug and 3 quarter barrott

Itm: I give and bequeath unto my son Thomas Andrew ye sum of ffive pounds to be paid as afores’d one 2 yearling heiffer, 2 blanketts one bushells of wheat and one chest, one brass pot.

Itm: I give and bequeath unto Joshua Andrew ye sum of ffive pounds to be paid afores’d and ye little horse.

Itm: I give and bequeath unto Anne Andrew ye sum of ffifty shillings together with ffifty shillings she owes me wch making up ffive pounds to her likewise. Itm: I give and bequeath all ye rest of my household goods, cattle and chattles whatsoever unto me belonging unto my son Benjamin Andrews whom I do hereby nominate & appoint to be my sole executor of this my last will and testament revoking, disannuling all former wills by me made or by any other writing whatsoever.
